Terms & Conditions

All orders by Here and There Notary are based on availability. Our team will always let you know if we are unavailable within 1-2 hours (which is why we request 2 hours' notice). Our team will not charge your card unless a Notary is assigned. 

 

General notary services are provided at an agreed-upon fee before booking. Your booking will include the State Minimum Charge Per Notarization and Travel Fee. The customer entering their card information is at liberty not to accept the fee posted. There is no obligation to purchase services. Our operations specialize in those who need mobile notary services.

 

All signings are non-refundable unless canceled in writing to contact@hereandtherenotary.com, at least 24 hours before the requested appointment time. By agreeing to these terms and agreements, it will be presented to your card provider in case of a chargeback. Payees also agree to pay all fees related to chargeback disputes. 

 

Services will not be assigned or rendered unless payment has been made in advance. Please note that we do not charge your card until the Notary has been assigned to your order.  Suppose your notary does not arrive within 30 minutes of your scheduled appointment. In that case, you may receive a negotiated discount on your services, but you may not cancel your services, especially on rushed orders. 

 

If your notary does not arrive within 1 hour of your scheduled appointment, you may receive a full refund if no services are rendered. If your notary is 1 hour late and services are still rendered, you may receive up to a 50% discount at management's discretion, but this will only apply to advanced bookings of 24 hours before your services.

 

All signings must be scheduled with a minimum of two hours' notice. 

 

​Purchasers understand that an on-time appointment is allowed only 15 minutes of grace before the appointment is considered canceled. This includes signers who refuse or cannot sign within 15 minutes of the appointment start time. Our mobile notaries do keep a rigorous schedule. 

 

All signers must have proper identification for a notarial act to be performed. This includes:

 

  • DRIVER'S LICENSE OR NON-OPERATING IDENTIFICATION LICENSE Requirements: Unexpired, issued by A state or territory of the United States.

  • U.S. PASSPORT Requirements: Unexpired. Issued by: The United States Department of State

  • ARMED FORCES IDENTIFICATION CARD Requirements: Unexpired Issued by: Any branch of the United States Armed Forces. 

  • OTHER GOVERNMENT ISSUED IDENTIFICATION CARDS Requirements: Unexpired; contains the customer’s photograph, signature, and physical description including: height, weight, eye color, and hair color. Issued by: The United States government, a state or U.S. territory, or a tribal government.

Credible witness: Someone who knows the signer and has one of the above ID type, and  is willing to sign the notary journal on your behalf as a witness and take an oath that you are who you say you are. This only applies in select states.

 

ID RULE EXCEPTIONS >> ONLY for real estate conveyance and financing in addition to the other forms of acceptable identification, a notary may accept the following forms of ID:

1. A valid unexpired passport issued by a national government other than the United States government and accompanied by a valid unexpired visa or other documentation necessary to establish an individual’s legal presence in the United States.

2. Any other valid unexpired identification deemed acceptable by the United States Department of Homeland Security to establish an individual’s legal presence in the United States, and that is accompanied by supporting documents as required by the United States Department of Homeland Security.

 

Improper identification or forcing the notary to wait more than 15 minutes for identification will result in cancellation without refund.

 

Signers must be coherent and willing to sign. If a notary is uncomfortable performing the notarial act because a signer is not willing or incoherent, no refund will be issued. 

 

  • Jail notaries must include proper identification. If you do not have appropriate identification (other than the state ID card), you must arrange for the guard or sheriff to act as a credible witness before the notary. If a credible witness is not provided, the notary will charge $1.00 per minute for waiting. Please note that inmates may take a long time to be brought out for notarization. You must understand that our appointments are scheduled for 1 hour only for jail notaries. After 1 hour, a $1.00 per minute fee will be applied to the bill. Please make sure to bring cash or a card with you to receive your notarized documents for Jail Signings.

  • Apostille Services:

    • All documents must be certified by the appropriate public official or a Notary. Only a certified copy of a document signed by a County Registrar or Recorder can be Apostilled. Copies should have a certification date within the last five years.

    • By using Here & There Notary Services,, I authorize Here & There Notary Services to obtain Apostilles or Authentications on my behalf.

    • I agree to indemnify and hold Here & There Notary Services and/or its agents and employees harmless from any liability, including Attorney's fees, that may be incurred herein and for documents lost or delayed in shipping or for delays at the Secretary of State or Department of Justice. Here and There Notary Services cannot guarantee shipping and/or delivery times. Here andThere Notary Services can not guarantee anything occurring as a result of force majeure.

    • You have been instructed not to purchase travel tickets or anything else until the Apostille or Authentications have been received. You are also instructed not to remove any staples, seals, or ribbons that may be attached to the Apostille once it has been received.

  • By using the services of the Here & There Notary Services, the Client agrees to be bound by these Terms and Conditions.
